In Mar 1844 John Thomas Gee was born to Thomas Gee (age 38) and Ann Goddard.

I, Frank GEE of COTEFIELD (age 42) within Edale in the parish of Castleton in the County of Derby Farmer declare this to be my last Will and Testament

I DIRECT the payment of all my just debts (except the sum of one hundred pounds of which I owe upon my promissory note) my funeral and testamentary expenses by my Executors hereinafter carried out of my personal Estate and from and after payment and satisfaction thereof

I GIVE devise and Bequeath all my Real Estate and the residue unto my nephews John Thomas GEE (age 24) of Kinder in the Parrish of Glossop in the said County of Derby , Farmer, and [his brother] James Albert GEE (age 20) Gladdins Mark [Map] near Ashover in the said county of Derby, Farmer, their heirs, executors and administrators and assigns according to the nature and tenure thereof respectively UPON TRUST to permit and suffer my dear wife, Elizabeth GEE (age 32), to have the use and enjoyment of all my household furniture, faming stock and other effects (except money or securities for money that shall or may be or not about the house and farm on which I reside at the time of my decease and also to permit and suffer my said wife to receive the rents and profits of all that my Estate called UPPER BOOTH Estate [Map] in Edale aforesaid until my youngest child shall obtain the age of twenty one years (provided she continue to live with my widow but not otherwise) she my said wife maintaining my children during their respective minorities or so long as they shall wish to reside with her during their respective minorities PROVIDED ALWAYS that if my said wife shall elect to reside on my said Estate called UPPER BOOTH

I DECLARE that she may do so until my youngest child shall obtain the age of twenty one years IN CASE she remarries my widow as aforesaid but not otherwise and as to for and concerning that my Estate called OOCLOW [JOW HOLE] Farm situated in Chinley in the Parrish of Glossop aforesaid and now in the occupation of Hannah FORD UPON TRUST that the said John Thomas GEE and James Albert GEE their heirs, executors and administrators or assigns (hereinafter called the trustee or trustees) do and shall do and shall receive the rents and profits thereof until my son, Edwin Arthur GEE, shall obtain the age of twenty one years or such other period as shall enable the said Trustees or Trustee to pay off the said Debt of one hundred pounds and the three several legacies of one hundred and fifty pounds each which I Bequeath to my Daughters - Emma, Jane, Alice Maria, and Eliza Frances - on their severally attaining the age of twenty one years AND I declare and direct until such period as aforesaid the said Trustees or Trustee shall invest the said rents and profits of my said Estate called OOCLOW [JOW HOLE] Farm in the names or name of the said Trustees or Trustee in any of the public stocks or funds or upon real securities in England and accumulate the same in the way of compound interest by investing the same and the resulting income thereof on or upon any such stocks, funds and securities as hereinbefore mentioned until thereby or therewith the said Trustees or Trustee shall be enabled to pay off and discharge the said debt and legacies AND FROM and after payment and satisfaction thereof I declare that the said Trustees or Trustee shall stand seized of my said Estate called OOCLOW [JOW HOLE] Farm To the use of my said son, Edwin Arthur GEE his heirs and assigns forever subject nevertheless to the payment of an annually or yearly rent of seven pounds ten shillings to my said wife and her assigns during so long as she shall continue my widow to be yearly incurring and payable out of and charged and chargeable upon my said Estate called OOCLOW [JOW HOLE] Farm THE SAID annually or yearly rent to be payable and paid to her my said wife or her assigns in equal half yearly portions in every year clear of all incidental expenses and deductions with a proportional sum for any functional portion of a half year which may happen immediately to forecast the determination thereof the first half yearly payment of the said annually or yearly rent charge to be made at the expiration of five calendar months after my youngest child shall attain the age of twenty one years AND THE said aforementioned share to be payable immediately after the demise or marriage of my said wife AND I hereby declare that in case the said annually or yearly rent charge of seven pounds ten shillings or the aforesaid proportional part thereof should be at any time be in arrears and unpaid in the whole or in part for the space of twenty one days and after any of the said days or times hereinafter appointed for the payment thereof then it shall go lawful for my said wife her executors administrators or assigns to enter and detain for the same and for the expenses occasioned by the non-payment thereof upon all or any part of the hereditaments hereby charged with the payment of the said annually or yearly rent charge in the same manner in all respects as Landlords are authorized to do for rents received on common leases for years and as to for and concerning all that my Estate called UPPER BOOTH I DECLARE that all the said Trustees or Trustee stand seized from and after my son Alfred Henry GEE shall have attained the age of twenty one years TO THE use of the said Alfred Henry GEE his heirs and assigns for-ever subject nevertheless to the payment of an annually or yearly rent charge of seven pounds ten shillings to my said wife and her assigns during so long as she shall continue my widow to be yearly issuing and payable out of and charged and chargeable upon my said Estate UPPER BOOTH THE SAID annually or yearly rent charge to be paid and payable to her my said wife at the like times and time and in the like manner and to be recovered and recoverable by the like ways and means as are hereinbefore mentioned and directed in the case of the annuity to my said wife charged upon and payable out of my said Estate called OOCLOW [JOW HOLE] Farm and from and after the decease or marriage of my said wife or the time when my youngest child shall have attained the age of twenty one years I DECLARE that the said Trustees or Trustee stand possessed of all residue of my said Personal Estate in trust for my said son Alfred Henry GEE his ancestors, administrators or assigns for his and their own use absolutely AND I devise all the freehold and copyhold hereditaments vested in me upon trust or mortgage unto the said John Thomas GEE and James GEE their heirs and assigns subject to the Equity of Redemption subsisting therein respectively but the money secured on such Mortgages shall be considered as part of my personal Estate AND I appoint my said wife Elizabeth GEE and the said John Thomas GEE and my said two sons Alfred Henry GEE and Edwin Arthur GEE Executors of this my Will and my said wife Guardian of my infant children AND I revoke all other Will or Wills by me heretofore made

16 Apr 1869. Proved at Derby the 16th day of April 1869 by the Oaths of Elizabeth GEE, Widow, the Relict, and John Thomas GEE, the nephew, two of the Executors to whom administration was granted. Power reserved to Alfred Henry GEE and Edwin Arthur GEE (now respectively minors) the other Executors where they shall have attained the age of twenty one years. The Testator, Frank GEE, was late of Cotefield within Edale in the parish of Castleton, in the County of Derby, Farmer and died on the 1st day of January 1869 at Cotefield aforesaid. EFFECTS: under £200.

14 Feb 1874. Will of [his father] Thomas Gee (age 67).

I, Thomas GEE (age 67) of the ASHES [Map] in Kinder in the County of Derby, Farmer, declare this to be my last Will and Testament and I revoke all previous Wills and testamentary instruments [testamentary literally means a trust in a will] made by me

I BEQUEATH to my son John Thomas GEE (age 29) the bond debts or Mortgages held by me and charged upon the tolls of the Chapel en le Frith and Enterclough and the Thornsett Turnpike trusts

WHEREAS I have contracted to purchase an Estate at Edale in the said County of Derby called OLLERBROOK [Map] estate from Messieurs Henry Clark and others but the purchase thereof is not yet completed NOW I direct that in case the said purchase shall not be completed at the time of my death my trustees shall complete the same and shall by mortgage of all or any part or parts of my real estate or otherwise raise such an amount as shall together with the residue of my personal estate not specifically bequeathed be sufficient to pay the purchase money of the said OLLERBROOK Estate AND I declare that the said Mortgage debt and all other Charges and encumbrances upon my real estate or any part or parts thereof at the time of my death and any other charge or encumbrance created in pursuance of the power and direction aforesaid shall as concerns my devisees be charged upon and paid by my respective devisees of my real estate in the proportions following namely of every forty two pounds of charges or encumbrances twenty pounds shall be charged upon the ASHES and other Kinder estates, fourteen pounds upon that part of the OLLERBROOK estate hereinafter devised to the use of my son [his brother] James Albert GEE (age 26), and the sum of eight pounds upon that part of the said OLLERBROOK hereinafter devised to the use of my daughter [his sister] Mary Ann (age 19), wife of James GODDARD.

AND THAT the interest upon the said charges and encumbrances shall be paid in the same proportions.

AND I also declare that the respective devisees may at their election first satisfy any charges upon their own respective estates and may also before or after so doing pay to any other devisee the proportion of the charges and encumbrances upon the estates of such first mentioned devisee in any payments and at any times they may deem convenient provided that not less than one hundred pounds shall be paid at one time and the person so paying such money shall not be charged with further interest upon the amounts so paid from the respective dates of payment thereof

I BEQUEATH to my Wife all my household furniture and effects for her use during her life and widowhood and at her death or marriage again I bequeath the same to my said son John Thomas GEE (age 29).

I DEVISE all my real estate both legal and equitable unto my two sons John Thomas GEE and James Albert GEE and their heirs To HOLD the same unto the said John Thomas GEE and James Albert GEE and their heirs as to the said ASHES estate and all other my hereditaments [any kind of property that can be inherited] in Kinder aforesaid now occupied by my said son John Thomas GEE to the use of my said son John Thomas GEE and his heirs forever SUBJECT to a share of any charges and encumbrances upon any part or parts of my real estate in the proportions aforesaid.

AS TO the said OLLERBROOK estate (except the portions thereof hereinafter specified) To the use of my said son James Albert GEE and his heirs for-ever subject to the share of any Charges and encumbrances upon any part or parts of my real estate in the proportions aforesaid

AND AS to these portions of the OLLERBROOK estate called or known by the names of the Coppice Wood, the Upper Latch Field, the Middle Latch Field, the Upper Latch Field Meadow, the Lower Latch Field, the Little Whinney Knowle, the Whinney Knowle, the farmhouse yard and other outbuildings on the east side of the Ollerbrook, the Lane, the Croft, the New Meadow, the West Hardy Stack, the East Hardy Stack, the Broad Piece, the Near Rough Ground, the Little Rough Ground, and the Further Rough Ground TO THE use of my said daughter Mary Ann GODDARD (age 19) and her heirs forever SUBJECT TO the share of any charges or encumbrances upon any part or parts of my real estate in the proportions aforesaid PROVIDED that my said wife shall have the use and occupation of the house adjoining that now occupied by me during her life and widowhood without payment of any rent

AND I charge as a first charge upon the whole of my real estate an annuity of forty pounds to my said Wife payable by half yearly installments to be paid at the end of half a year from the date of my death such annuity to cease upon her second marriage

AND I appoint my said sons John Thomas GEE and James Albert GEE Executors and Trustees of this my Will.

26 Jan 1877. Codicil to the will of [his father] Thomas Gee (age 70)

THIS IS A CODICIL to the Will and Testament of me Thomas GEE of the ASHES in Kinder in the County of Derby Farmer WHEREAS by my last Will and Testament date the fourteenth day of February one thousand eight hundred and seventy four I have given and devised my Real Estate but have not bequeathed my personal Estate. NOW I hereby give and bequeath unto my said son John Thomas GEE (age 32) absolutely all my personal Estate Stock in Trade personal Chattels and Effects money in the house or at the Bank and in all other respects I confirm my said Will.

IN WITNESS whereof I have to this codicil to my last Will and Testament set my hand this twenty sixth day of January one thousand eight hundred and seventy seven

THIS IS A FURTHER CODICIL to the last Will and Testament of me Thomas GEE of the ASHES in Kinder in the County of Derby Farmer WHEREAS by my said Will I have charged who in my real estate in the proportions therein mentioned all charges and encumbrances upon my real estate pr any part or parts thereof but have not charged my other debts upon such real estate

NOW I DO HEREBY DECLARE my Will to be and I do hereby order and direct that all my debts shall as concerns my devisees named in my said Will be charged upon or paid by my respective devisees of my real estate in the proportions in which the charges and encumbrances mentioned in my said Will are to be charged upon and paid by my respective devisees of my said real estate

NOW I DO HEREBY devise and in lieu thereof I devise the before mentioned revoke the said last mentioned portion of the said OLLERBROOK estate to my said sons John Thomas GEE and James Albert GEE and the survivor of them and the heirs of such survivor TO HOLD the same unto the said John Thomas GEE and James Albert GEE and the survivor of them and the heirs and assigns of such survivor TO THE USE of and upon trust for my said daughter Mary Ann GODDARD (age 22) during her life for her sole and separate use and after her death Upon such trusts my said daughter whether covert or sole shall by her last Will and Testament direct or appoint Subject…….

NEVERTHELESS to the share of any charges upon any part or parts of my real estate in the proportions afore mentioned in my said Will or this Codicil. I DIRECT that my funeral and testamentary expenses shall be paid out of my personal estate AND in all other respects I confirm my said Will and the Codicil thereto dated the twenty sixth day of January one thousand eight hundred and seventy seven.

On 30 Jan 1877 [his father] Thomas Gee (age 70) died. John Thomas Gee (age 32) inherited Ashes Farm, Kinder [Map].

On 02 Jun 1882 [his mother] Ann Goddard died.

30 May 1883. Will of [his mother] Ann Goddard. [Note. Three days before she died.]

THIS IS THE LAST WILL and Testament of me Ann GEE of the ASHES farm [Map] in Kinder in the County of Derby Widow

IN EXERCISE OF the power given to me by a certain indenture dated on or about the twelfth day of August one thousand eight hundred and sixty eight and of all other powers and authorities enabling me in this behalf

I DO HEREBY appoint give and devise unto my sons John Thomas GEE (age 39) and [his brother] James Albert GEE (age 35) and my nephew James NIXON their heirs and assigns all my share estate and interest of and in all that dwelling house outbuilding land and hereditaments comprised in the said indenture situate at Chinley and called the OWLERS in the occupation of William HANCOCK as tenant upon trust to sell the same AND I DECLARE that the money arising from such sale shall form part of my residuary estate

I DEVISE AND BEQUEATH all the residue of my estate property and effects whatsoever and wheresoever unto the said John Thomas GEE (age 39) and James Albert GEE (age 35) and James NIXON their heirs executors administrators and assigns upon trust to sell and convert into money such part thereof as shall not consist of money and out of the money arising from such sale and conversion and out of my ready money to pay my funeral and testamentary expenses and debts and in trust to apply the residue of the said monies including the money arising from the sale of my share in the said premises called the OWLERS in payment of the debts charged upon the real estates of my late husband by a codicil to his will dated the 27th January 1877 in the proportions in which the charges and encumbrances mentioned in the will of my said late husband are to be charged upon and paid by his respective devises of his real estates

I APPOINT THE SAID John Thomas GEE (age 39) and James Albert GEE (age 35) and James NIXON executors of this my last Will

IN WITNESS WHEREOF I have hereunto set my hand this thirtieth day of May 1883 … Ann GEE

PROVED AT Derby the twelfth day of October 1883 by the oaths of John Thomas GEE and James Albert GEE the sons, two of the executors to whom administration was granted, power being reserved of making the like grant to James NIXON, the nephew the other Executor.

THE TESTATRIX Ann GEE was late of the ASHES in Kinder in the County of Derby Widow and died on the second day of June 1883 at the ASHES aforesaid. Gross value of personal estate £61. Extracted by H. S. Chinn Proctors, Derby.

On 25 Nov 1921 John Thomas Gee (age 77) died. He was the last of the Gee family at Ashes Farm, Kinder [Map].
